What is an estate?

An estate is the property that you own. The term “estate planning,” covers the use of your property for your own benefit during your lifetime, as well as the distribution of your property on your death.

How is an Estate Distributed?

By Will

If you die with a properly drawn and executed will, your property will be distributed to the beneficiaries designated in your will. These can be family members, friends, charities, or any other person.

Without a Will

On the other hand, if you die either without a will, or with a will that has not been properly executed, your property will be distributed to your heirs as specified by the California law.

By Trust

Another way that property is distributed is through a trust. A trust is very similar to a will, but usually can be carried out, without having to involve a probate proceeding, as explained below.

By Ownership

Holding title to property in joint tenancy can result in your interest in the property passing to the surviving joint tenants upon your death.

By Beneficiary Designation

IRA’s, annuities, bank accounts, insurance policies, and securities accounts can provide for the transfer of the ownership of the property to another person upon your death.

What is probate?

Probate is a special court that is part of the San Diego Superior court. If your property exceeds a certain value on the date of your death, whether you have a will, or don’t have a will, a probate proceeding may have to be opened. Probate proceedings are open to the public and typically take a year or longer to complete. There are costs of probate that have to be paid before your property is distributed. Because of the time and expense of probate proceedings, most people desire to avoid probate either through the use of a trust, or alternative method, because the property is distributed much faster, at a lower cost, and under terms that do not have to be made public.

Powers of attorney can be used by you to appoint persons to make health care decisions for you, and to deal with other persons regarding your property for your benefit.
